Gov’t to simplify byelaws

SHILLONG, DEC 12: The state government today assured to come up with legislative measure to dispel the apprehension that the Meghalaya Urban Development Authority (MUDA) is extending its authority beyond municipal areas while implementing the building byelaws.

“We are looking at legislative exercise to deal with these challenges. Therefore there will be due diligence resorted to by the government and we have already decided,” Sangma told reporters after a meeting with traditional heads here on Tuesday.

He said that the government will be looking at what can be the best format made available to the authorities not necessarily to MUDA but find out other authorities which are completely segregated from the authority which enforces certain laws within the municipality areas.

According to him, the authority will be vested with the responsibility of implementing various parameters required to ensure safety of the buildings while keeping in mind challenges associated with disaster and that Meghalaya is seimic prone state.

“We also are govern by various laws in respect to disaster therefore how we can look at those associated and binding responsibility vis-à-vis those laws and how can there be synergy and there is no conflict of laws,” he said.

Asked, Sangma said there is this perception linked to apprehension of the MUDA extending its authority beyond municipal areas is a matter of concern adding there is need to look out on how the whole procedure can be format properly.

With regards to the inconveniences faced by people residing outside the municipality area, he informed that the department have been asked to further fine tune this rule in such a way that will give clarity on the timeline required for processing of the applications relating to building occupancy and clearances required under the MUDA byelaws.

“We have also discussed as to how we can look at simplifying the whole system,” he said.

The headmen have been demanding withdrawing the operation of the MUDA building byelaws from areas falling outside municipality.

However referring to the ruling of the Court on this regard following a petition filed by a citizen, Sangma said because of this, the earlier notification to keep in abeyance the application of MUDA  bye-laws  in areas outside municipal areas have been further unoperational and therefore the byelaws becomes operational even outside municipal areas.
