Cong urges top Court to withdraw its judgment over Rafale issue

IMG_20181218_151627SHILLONG, DEC 18: Opposition Congress MP from Assam Gaurav Gogoi today said the Supreme Court should withdraw its recent judgment because of the “false statement” made by the BJP-led NDA government to hide its lie over the Rafale issue.

He also challenged the Narendra Modi government to constitute a Joint Parliament Committee (JPC) if it has nothing to be afraid of.

“Based on the false statement made by the BJP government, the Supreme Court should withdraw its judgment because the false witness has been prepared by the Modi government,” Gogoi told reporters at a news conference held here on Tuesday.

He said, “The Supreme Court should penalise the BJP government for trying to lie and mislead the highest Court in this country. The Supreme Court should call upon theh government and initiate actions of contempt and initiate an action of forgery against the BJP government.”

The Congress leader said the party is also demanding for an investigation by the Joint Parliament Committee (JPC) citing that the Supreme Court is not the appropriate forum to identify the corruption and the benefits given to crony capitalists in the Rafale scam.

He said this is because the modified decision into the Rafale saga was made by none other than the prime minister himself and not the defence minister or the foreign minister.

According to him, they (defence and foreign ministers) had no inkling about the modification the prime minister was going to make which is from 126 to 36 Rafale jets and increasing the price per jet from Rs 560 crore to Rs 1600 crore.

“We want the prime minister to depose before the JPC and tell us on whose experts’ advice did he make such a huge decision on a tender that was already been awarded and on whose advice he cancelled the original tender and gone for this new deal,” Gogoi said.

Stating that it was only 12 days before the PM’s visit to France a company which has got no prior experience was given the deal (for the purchase of Rafale jets), he said, “The truth of the nexus between PM and Anil Ambani will come out so let there be a JPC. If the BJP has nothing to be afraid of they should initiate the JPC and let the tax payers of the country whose money have been used to buy these jets and benefits Anil Ambani let the tax payers have the right to find out what kind of crony capitalism has done with their money.”

He further stated that the then Congress government had agreed to the demand of the BJP for setting up the JPC adding “Then why is the current BJP government so allergic when they were in the opposition they loved the JPC now in they are in the ruling they have developed an allergy to it, that means they have something to hide as they don’t want the facts of the matter to come out but the Congress has always said that you can spit hundred lies to cover the original lie but a lie is a lie and one day the truth will come out.”

Asked, Gogoi said it is highly incredulous on the government of India that it tried to convince the Supreme Court that a CAG report has been compiled and submitted to the Public Accounts Committee and it was also placed in the parliament and it is in public domain.

“All of these are lies. The CAG report is in the draft stage it is yet to be submitted to the government. The CAG report has not been given to the PAC whose chairman has done press conference on this also,” he said.

Referring to the press conferences by the BJP on the matter, the MP said the JPC will reveal if they are speaking the truth or we are speaking the truth adding through their press conferences they are again trying to hide the truth.

He however said but the people of India know that in this country when farmers are not getting their loans waived off there are few industrialists who take crores of money and they are able to fly away to foreign countries under protection of the Prime minister.

Earlier, Tripura chief minister Biplab Kumar Deb who was in the city here yesterday has alleged that there is an “international conspiracy” behind the allegations of AICC president Rahul Gandhi who has racked up the issue of Rafale as a scam.

When sought for his comment on this, the Congress leader said the BJP and RSS are masters of lies adding there is no international conspiracy but there is a domestic conspiracy and that conspiracy is between the prime minister and Anil Ambani himself.

“It is a conspiracy to earn money, it is a conspiracy in which the PM himself involved and it is the conspiracy against the people of India so people of India know that today PM might say that he is a chowkidar but the common perception is that the “chowkidar himself is a chor”,” he said.

Alleging the BJP of trying to hoodwink the Supreme Court, Gogoi said that since the Congress is not a party to the petition, it is making this public appeal and it is for the Court to decide on the appropriation action against the matter.

In its judgment last week, the Supreme Court had given the Narendra Modi government a clean chit on the procurement of 36 Rafale fighter jets from France and dismissed all the petitions seeking a direction to the CBI to register an FIR for alleged irregularities in the deal.
