Cop’s murder: HC makes CBI party

SHILLONG, JULY 21: The Meghalaya high court on Tuesday ordered that the CBI should be made party to the petition filed by late sub inspector Pearly Stone Joshua’s mother asking for CBI probe into the death of her son.

The court has directed that the CBI should be made a party to the petition, sources said.  Sources said the court has fixed the next hearing on the petition a week later.

The petition was filed before the court after the state government constituted Special Investigating Team (SIT) probing into the murder case failed to submit its report even after the deadline expired on June 18.

In her petition, the mother stated, “The SIT has failed in all aspect in investigation of the matter and could not draw any conclusion till date as such prays that the direction may be passed for handing over the case to the central bureau of investigation (CBI) for ends of justice.”

On January 24 this year, Marbaniang, who was the in charge of Patharkhmah police outpost in Ri Bhoi district, was found critically injured with a gunshot on his head in his official quarter, a day after detaining several illegal coal trucks.

Police had then claimed that Marbaniang, had allegedly shot himself with his service revolver and it is clear case of suicide but later when deceased’s wife lodged an FIR, a murder case was registered.

The mother of the former cop also said that the incident happened soon after detaining 32 trucks carrying coal illegally to Assam and as such this lead to a strong suspicion that he might have been killed for detaining the trucks.

“Therefore, it is prayed that free, fair and independent investigation through CBI may be directed in order to bring the culprit to light or else every honest and brave person who dare to raise voice against such social evil will be eliminated in the name of ‘suicide’,” she stated in the petition.

Stating that the CHC Nongpoh have issued a Certificate of Death of the death of her son (L) PJ Marbaniang, which clearly shows that he died at 8.50 pm on January 24, the mother said, “In spite of the fact that her son was dead at 8.50 pm on January 24, but yet a whole drama was played and her son was taken to GNRC, Guwahati for reason best known to the investigating agency which has led to disturbing the crime scene and further led to destruction of evidence and has become fatal for the investigation of the case.”

The mother also alleged that a false certificate was again issued by the GNRC, Guwahati about her son’s date of death that put is on, January 25.- By Our Reporter
