SHILLONG, JUNE 9: The Meghalaya high court has directed the South West Khasi hills district Deputy Commissioner and Superintendent of Police to appear in person before the court on June 15 at 10:30 am with regard to a case of keeping a mentally challenged twenty nine old Slinder Turnia in a cell by the Ngundro Village dorbar headman and secretary of South West Khasi hills district.

South West Khasi hills SP has also been directed by Meghalaya high court justices T Nandakumar Singh and SR Sen to ensure that the  personal appearance of the headman and secretary of the Dorbar of Ngundro village before this court on the same day and time to explain as to why they take the law into their own hands in the name of social service.

It is alleged that Turnia was confined in a cell by the headmen and secretary on the request of his family so that the mentally challenged will not harm anybody.

However, the court on Tuesday observed that in spite of its order dated 27.4.2015 directing all the DCs as well as Senior SPs and SPs to ensure that no mentally challenged person is seen abandoned by his family or roaming about uncared in public places, or in other places inviting danger and causing inconvenience to public, it is not getting any response from the DC and SP as expected.

Taking cognizance of a news report “Dorbar confines mentally ill person” that appeared in one of the leading local English dailies the Meghalaya high court passed the said order of PIL.No.1 of 2015.

The high court judges said in the news item, it is stated that one mentally unstable person identified as Slinder Turnia (29) has been kept confined in a cell on the request of his relatives and accordingly in the interest of the denizen of the state and also in the interest of the public.

The judges directed the Deputy Commissioner, South West Khasi Hills District, Mawkyrwat to take immediate steps for shifting of the mentally ill Slinder Turnia to a mental asylum so declared and recognized by the state of Meghalaya for treatment.

The court order said in the peculiar circumstances of this case, the Headman and Secretary of the Dorbar of Ngundro Village of South West Khasi Hills District are to appear in person before this Court on 15-06-2015 at 10:30 am sharp to explain as to why they take the law into their own hands in the name of social service.

The court order also said Superintendent of Police of South West Khasi Hills District, Mawkyrwat is directed to ensure the personal appearance of the headman and secretary of that village before this Court without fail at 10:30 AM sharp on 15-06-2015.

The court direction further said the Deputy Commissioner and the Superintendent of Police of South West Khasi Hills District, Mawkyrwat, shall also appear in person before the court on June 15 at 10:30 am sharp.- By Our Reporter
