HC seeks medical report of accused arrested in Ichamati-clash incident

SHILLONG, MAY 29: The Meghalaya High Court has directed the Tura district jail to submit a medical report of an accused person, who was arrested in connection with the Ichamati-clash incident, on June 6.

The court was hearing a bail application filed on behalf of Sushen Das, who is presently in judicial custody and lodged in Tura district jail, West Garo Hills, on Friday. Das was arrested on February 29, in connection with a case registered with the Shella police station.

“…I am of the considered opinion that the latest medical condition of the accused is required to be perused by this Court. Accordingly, I hereby direct the doctor of the District Jail Tura to examine the accused, and if proper facility is not available at the District Jail to cause the accused to be thoroughly examined at the Civil Hospital and thereafter, to file a report in this regard before this Court on the next date fixed (on June 5).The Superintendent, District Jail Tura is hereby directed to ensure due compliance of this direction,” Justice W Diengdoh said in his order.

The order also directed investigation officer also produce the case diary since charge sheet has already been filed against the accused.

Earlier during the hearing, the counsel for the petitioner K Paul informed that the accused is suffering from Bronchiectasis and lung collapse particularly left lung, as such, he is entitled to be released on bail, considering his medical condition for which sufficient surety will be produced.

However, the AAG B Bhattacharjee said that materials on record as produced have cast a doubt on the veracity and authencity of the petitioner’s claim as far as the accused is concerned.

He pointed out that there is a discrepancy as far as the name and age of the accused is concerned, particularly the details of the OP Prescription as seen at Annexure 2, page 11 2 of the application, which is the medical investigation report issued by the Apollo Gleneagles Hospitals, Kolkata showing the patient’s name as Sushan R Das, aged 46 years 8 months 24 days and the date of visit being noted as 5th May 2018.

However another document issued by the Department of Radiology of the said Apollo Hospital showing the report of the CT Scan Chest with Contrast has given the patient’s details as Sushan R Das and the age as 45 years, Bhattacharjee stated.

Meanwhile, the Assistant Inspector General of Police (AIGP) GK Iangrai had recently informed that

a total of 70 accused have been charge-sheeted under relevant section of Indian Penal Code and Prevention of Damage to Public Property Act in connection with the Ichamati incident.

It may be mentioned here that (L) Lurshai Hynniewta, a KSU member was killed after being attacked by non-tribals at Ichamati village on February 28.
