Mooshahary: Make justice affordable to the poor

sbaSHILLONG, JUNE 5: Meghalaya Governor Ranjit Shekhar Mooshahary said the newly formed Meghalaya high court must ensure a reasonable time frame for adjournment of cases as it will ensure speedy justice delivery system and make justice affordable to the poor.

Addressing the centenary celebration of the Shillong Bar Association (SBA) held at the U Soso Tham auditorium on Wednesday Mooshahary said, “The court should not make justice an expensive affair for people and set a reasonable time as far as adjournment is concerned.”

Established way back in 1913, the Shillong Bar Association has around seven hundred members now.

Mooshahary was of the opinion in today’s context ‘justice’ has a different concept for the rich and the poor as the rich finds it more affordable but the poor have to backtrack because it involves financial implication to pursue the case. He said, “The poor and under-privilege are discouraged to fight against the rich and willing tolerate all the injustices which should not be in a human society.”

Mooshahary said if the Meghalaya high court can ensure speedy disposal of justice it can be replicated throughout the India.

Mooshahary called the lawyers as warriors of criminal justice administration and that constitute the foundation of justice dispensability. However, he warned, “But they also have to function within parameters while performing their duties to improve and ensure that justice is dispense to people who are on the side of truth besides making justice accessible to the poor and less advantage group.”

Pointing out that law is very neutral but depends on the one who interprets it, Mooshahary said, “However, what you may interpret now may not be good for tomorrow as nothing is actually final. Anything can be change with new points according to present day need.”

Meghalaya high court judge SR Sen observed that the present scenario is not very welcoming pointing to the recent case where a lawyer had tried to mislead the court by producing a manufacture judgment order of the court.  He said,“I have asked for a detail enquiry into matter.”

Sen urged the legal fraternity to refrain from misusing and abusing their power.

Agreeing with Mooshahary that the justice system is slow, Justice TNK Singh informed that the Meghalaya high court would soon set up independent district judiciary divisions in Tura (West Garo hills), Jowai (West Jaintia hills and Ri Bhoi districts in order to speed up the justice delivery system.- By Our Reporter
