HC orders police to find Pearly murderers

SHILLONG, JULY 28: The Meghalaya High Court today directed the state police to find the persons behind the death of a former sub-inspector, (L) Pearly Stone Joshua Marbaniang.

The direction was a verbal order given by the Chief Justice Uma Nath Singh on Tuesday during a hearing on the writ petition filed by the mother of the deceased cop, D Marbaniang, sources said here.

Sources said, “The court has asked the state police to find the persons involved behind the death of the former cop.”

During the hearing, the chief justice had also mentioned that the he is yet to come across a case where a person commit suicide from the back of his head, the sources said.

Earlier, the state police had also submitted an affidavit in opposition to the writ petition of the deceased’s mother, who had sought the court’s intervention for immediate handing over the case to the Central Bureau of Investigation (CBI) for end of justice.

The affidavit in opposition which was filed by Assistant Inspector General of Police GK Iangrai  while strongly refuted the allegations made by the petitioner (D Marbaniang) that the special investigation team (SIT) constituted by the government has failed said, “The allegation is totally incorrect and motivated.”

“In fact, the case transferred to the SIT is one where there is no witness to the death of (L) SI PJ Marbaniang. Hence, the SIT has to acquire and piece together all circumstantial evidences to ascertain the circumstances and facts leading to his death,” the AIGP said.

He informed that the dead body of the deceased cop was exhumed after obtaining the order of the Court for 2nd PM examination to get a definite answer to the doubts which had arisen due to conflicting reports.

“A total of 107 persons have been examined with regard to the case till date,” AIGP said while informing that the place of occurrence has been reconstructed taking into account all available parameters which have emerged in the course of investigation.

Call detail records (CDR) analysis of several persons connected with the case have been obtained to help in getting more inputs on the links and patterns of calls, the affidavit in opposition stated.

Stating that considering the peculiar nature of the case where several factors are involved, it stated, “The SIT had to re-examine several persons again in the light of emerging facts. SIT had to wait for several Forensic reports to aid in the investigation.”

According to him, at this juncture the SIT investigation is on the stage of completion and pending for the CFSL report from Hyderabad of Phones and Laptop at (L) SI PJ Marbaniang which will be received shortly which is crucial for the investigation.

The AIGP further admitted that it is a fact that the medical report issued by the SMHO, Patharkhmah PHC contradicts the post mortem report issued by the DMHO Nongpoh Civil Hospital.

He said that this contradiction therefore led to the investigation where for a second post mortem was conducted by a team of medical doctors of NEIGRIHMS which has allayed the doubt raised in this para by the petitioner on the grounds that NEIGRIHMS deployed a team of forensic for conducting the post mortem of (L) Marbaniang on the ground that Dr MD Momin of Nongpoh Civil Hospital in his statement stated that “I had entered the date and time of death as January 24, 2015 at 8.50 pm in the death certificate given to the relatives as per the inquest report of the officer who conducted the inquest and forwarded the dead body for post mortem examination.”- By Our Reporter
