SHILLONG, AUG 24: The Khasi Hills Autonomous District Council (KHADC) has opposed the decision of the government to notify the extension of the Code of Criminal Procedure (CrPC) and Code of Civil Procedure (CPC) in tribal areas of Meghalaya.
The resolution taken by all MDCs in a meeting held on August 1, was submitted to the Chief Minister Conrad K Sangma on Wednesday.
“Hence, the meeting resolved to oppose the Extension of the Code of Criminal Procedure and Code of Civil Procedure to the tribal areas of Meghalaya,” KHADC chief Titosstarwell Chyne said.
He said this was after the state government had anticipated notifying the Extension of the Code of Criminal Procedure (CrPC) and Code of Civil Procedure (CPC) to the whole state of Meghalaya.
“Under the Sixth Schedule to the Constitution of India the District Council Court has exclusive jurisdiction to hear and try cases between tribals in tribal areas and implementation of CrPC and CPC in tribal areas will have an impact on the jurisdiction of the District Council Court and also the Village Court and the Additional Subordinate District Council Court which are functioning as per the prevailing customs,” Chyne stated.
