Kharshiing to seek disqualification of the 12 former NCP MLAs

Shillong, August 30: Former Rajya MP and NCP observer for north eastern region Robert Kharshiing will be seeking the disqualification of the twelve NCP legislators who had merged with the National People’s Party (NPP).

Kharshiing was schedule to posted letter to Meghalaya Assembly Speaker Charles Pyngrope Thursday seeking the disqualification. Speaking to www.ohmeghalaya.com Kharshiing said, “I will be posting a letter to  Speaker of Meghalaya Assembly seeking disqualification of 12 MLA’s who have joined NPP”.

Kharshiing said that as the NCP is a national party joining a new party with only 12 legislators from Meghalaya will attracts disqualification of these members under the anti-defection act.

Kharshiing informed that according to the Supreme Court ruling, the Speaker’s ruling can be challenged at any court provided that the speaker had ruled otherwise after being approached. He said the only condition for challenging the Speaker’s ruling is that no one can approach the court directly without having knocked at the Speaker’s door.

Giving a clear indication that the NCP is going to pursue the disqualification case, Kharshiing said that in case the speaker doesn’t act on his request, he has his other options and was even willing to take up the disqualification case against AL Hek who had left the BJP and joined the Congress.

Kharshiing, however, said had the merger been of a regional party like the UDP then the case would have been different as the anti-defection act would not have worked against them. –By Suraj Joshi
