Murder case dropped

SHILLONG, FEB 17: The state police on Wednesday dropped the “attempt to murder” charges against the tourist-taxi driver after ascertaining that it was a case of sheer negligence and rash driving.

Accordingly the police have also filed charge-sheet against the driver under section 279/336/427 which related to rash and negligence driving, any acts endangering life and mischief causing damage.

“The section 307 IPC (attempt to murder) has been dropped however charge-sheet has been filed against him (driver) U/S 279/336/427 IPC,” East Khasi hillsSP M Kharkrang told reporters.

Jeskalur L Mawdoh (25), a driver of the Mahindra Maxi cab (ML 04A 3374), which hit the official vehicle carrying the Chief Minister Mukul Sangma on February 11, was earlier arrested and booked under section 307 of the Indian Penal Code (IPC).

Kharkrang said, “Investigation into the matter conclusively ascertained that the driver commuting from Shillong to Nongkhlaw through sheer negligence and rash driving dashed against the CM’s vehicle.”

Clarifying on the decision to book the driver under such a section (307 IPC), the SP said, “The circumstances whereby a static vehicle, in the same direction driven by Mawdoh hit a ‘Z’ plus category protectee (CM) causing a serious security breach appeared prime facie dangerous and suspicious. Hence a case under section 307 IPC was registered.”

According to him, the scope of the investigation was to ascertain whether there was any malafide intention to cause harm to the chief minister who is already placed in the highest security threat and if any, to ascertain the conspiracy behind it.

“Therefore a thorough investigation warranted custody of the alleged accused to ascertain all facts of the incident and any delay in investigation will result in loss of crucial evidence,” he stated.

Referring to the incident, the SP said the CM was on his way  to the ALG Helipad and on reaching 3rd Mile, Upper Shillong, the Mahindra Maxi cab moving in the same direction was stopped by the traffic constable on duty to allow the Carcade to move by.

“The vehicle in question was also waved down by the pilot car of the CM’s carcade by which time it had stopped. However as soon as the CM’s vehicle passed by it, the tourist vehicle veered to the right and immediately made an unexpected dash against the CM’s vehicle from the side he was seated,” he said.- By Our Reporter
