Speedy compensation

SHILLONG, SEPT 4: Meghalaya government on Thursday directed all the deputy commissioners of the state to create a corpus fund to ensure that victims are not subjected to undue delay to avail the Meghalaya Victim Compensation Scheme (MVCS) which was revised and approved by the cabinet.

“The notification of the revised Meghalaya Victim Compensation Scheme has been approved by the Cabinet,” Chief minister Mukul Sangma told reporters after the cabinet meeting on Thursday. He said  directives have been given that a corpus fund is created which will be placed at the disposal of the deputy commissioners so that as and when it is  required to pay this compensation to the victims they can do expeditiously without the long processing procedures.”

“We have suggested that every deputy commissioners should have at least 20 -25 lakh of corpus fund,” Sangma said.  According to him the proposal was brought of the fact that on number of occasions though there is a scheme to pay compensation but there is undue delay.

“So in order to make it simpler and short, we have structured it appropriately to ensure a corpus fund is place before the deputy commissioners so that victims can avail the scheme without any problem,” Sangma stated.

Sangma said the compensation scheme is required to be implemented in time bound manner because there is a need to comply with the ruling of Supreme Court. He informed that the scheme will be administered through the State Legal Service Authority (SLSA).

Cabinet has also approved the notification for implementation of the ‘Right to Fair Compensation and Transparency in Acquisition and Rehabilitation and Resettlement Act 2013’.

The centre government last year came up with an important law which has been passed by the name of Right to Fair Compensation and Transparency in acquisition and rehabilitation and resettlement Act 2013, Sangma said.

Sangma informed that based on this, as the state government acquires land from rural areas as the evaluation of such lands in the rural areas is invariably lower than in the urban areas and this particular multiplier mechanism is required to be adopted by respective state governments and accordingly notify based on which the revenue department will determine the value of those lands.

Sangma said, “Therefore, all those lands which are in the pipeline for acquisition including Guwahati – Shillong four laning, Umsning bye pass, particular provision of this new Act will be invoke.”

As per the provision of this Act, Sangma said, “The amount of compensation to be awarded to for the land acquire will have to take into consideration the market value as determined under the relevant sections of the Act which refers to the market value of land in rural areas which will be based on the distant from the urban centres.”- By Our Reporter
