Champion bail plea finally accepted

SHILLONG, DEC 17:  The bail application of the Garo National Liberation Council (GNLA) chairman Champion R Sangma has been accepted Monday as the court has called for the case diary (CD) giving a glimmer of hope to the militant leader to contest the upcoming Meghalaya assembly election slated for February 2013.

Sangma had been arrested in July 30. His lawyer Sujit Sangma had moved the court many times earlier for his bail but the court had rejected it. However, Monday the court accepted the bail application   as the magistrate of Nongstoin failed to charge sheeted the cases against Sangma even after the mandatory 90 days had expired.

As per section 167 CrPC after the if charge sheet is not filed within 90 days by the prosecution then the accused has the right to go on bail.

Confirming this Dey said, “The bail application was filed under section 439 and court was please to call for the Case Dairy (CD) to verify that whether the charge-sheet is file or not within 90 days.”  He informed that probably the case will be taken on January 11 if there is a vacation court for hearing.”

Champion has  two cases against him which is Nongstoin case no 9 (2) of 2012 under section 121 A, 353, 307 and 34 IPC/ section 10 and 13 of Unlawful Activities Prevention Act and 27 (2) of Arms Act. However, the charge-sheets against the two cases in Nongstoin are yet to be file even after expiry of more than 90 days.

Before Monday two bail applications were moved by Dey which was rejected.

Of late the militant leader has been more in the news for his announcement that he would be contesting the upcoming assembly election and support the Congress. He had even said that he had asked the GNLA cadres to support the Congress during election.

An embarrassed Congress had to immediately distance itself from Sangma’a announcement as it faced flak from its political rival who accused the party of having links with the militant outfit.- By Our Reporter
