HC directs govt to file affidavit

SHILLONG, OCT 15: The Meghalaya High Court has asked the state government to file an affidavit with regards to dilapidated condition of the road leading to the North Eastern India Gandhi Regional Institute of Health and Medical Sciences (NEIGRIHMS).

The matter came up during the hearing conducted by the division bench headed by chief justice Mohammad Yaqoob Mir and Justice SR Sen, which has taken sou motu cognizance on the condition of the National Highway 40-Shillong to Dawki, here on Monday.

Amicus Curiae highlighted that the road from Shillong to NEIGRIHMS is totally in a dilapidated condition.

NEIGRIHMS, one of the prestigious medical institutes, is located in that area and it is an upcoming town, as most of the important institutions are located there.

In the public interest, it is the obligation of the welfare State to ensure proper road connectivity more so, for ailing people who often require treatment from NEIGRIHMS.

Learned Addl Sr.GA assures that the matter will be taken up with the Government and they will come up with the plan/suggestion regarding widening and resurfacing of the road from Shillong to NEIGRIHMS.

The bench in its order has directed that an affidavit shall be filed on or before the next date.

In compliance with the order passed on September 17, the executive engineer of the PWD (roads) NH Division, Shillong in an affidavit informed that the damaged portion of the road starting from Wahkdait to Dawki – pot hole repairing of remaining 90 meters has been completed.

He said that for resurfacing the entire stretch, the contractor has been impressed upon to complete it within four months.

Earlier it was fixed as 12 months which was not acceptable therefore, the Executive Engineer shall ensure that resurfacing is got done within four months, the bench said.

Regarding the road from 7th mile to Pynursla, the contractor, according to the Engineer, was requested to complete the resurfacing works within four months.

On this, the bench directed the Executive Engineer to ensure that the same is translated into action and work is completed within the time fixed.

Amicus Curiae in the meantime shall also collect the information about the present status of the work regarding roads as referred to hereinabove.

Meanwhile, the bench has also directed the Addl Sr GA to file the latest status on the road from Tura to Baghmara and from Baghmara to Siju, which the latter had informed that the construction work and repairing is in progress except for some portions due to certain disputes of which corrective measures have been taken.

Meanwhile, the Court has fixed November 5 as the next date of hearing on the  matter.
