Apartment ownership ordinance 2015

apartmentSHILLONG, DEC 15: Meghalaya cabinet on Tuesday approved the Meghalaya Apartment Ownership, Ordinance 2015, for regulating the ownership of individual apartments across the state.

“We have approved the Meghalaya Apartment Ownership Ordinance 2015 for the purpose of regulating the ownership of individual apartments in the state,” Chief Minister Mukul Sangma told reporters after a cabinet meeting on Tuesday.

According to the chief minister, the state government felt it necessary that there should be some kind of legislative mandate for regulating after number of such apartments have start coming up in the city as well as in other districts of the state.

Giving more insight into the objective of the ordinance, Meghalaya urban affairs minister Ampareen Lyngdoh said, “The ordinance aims to provide for the ownership of an individual apartment in a building together with an undivided interest in common area facilities and basically this would indicate management, maintenance, equal responsibilities and contribution for the same for all owners of the apartment.”

Stating that the ordinance has also zeroed down on the roles of developers and the owners, Lyngdoh said, “It also talks about formation of associations and systematic provisions for the formation of such associations. It also speaks about the notion values and subsequent calculation for registration, distribution of common profit of the property.”

Lyngdoh said the ordinance also provides for the provision of penalty for any contravention of the rules and provision by an individual or group to include promoters, association or apartment owners.

Meanwhile, the chief minister further stated that the ordinance will ultimately enables the state government to ensure that the provision of the Meghalaya of Land Transfer Regulation Act, 2971 applies.

“While applying the provision of this particular law, it will also enable our owners of the apartments whoever buys a flat in an apartment to protect their interest in respect of the interest inheritable and tranferable,” Sangma said.-By Our Reporter
